CULTURA JURÍDICO-PENAL E CIDADANIA NO BRASIL CONTEMPORÂNEO
Resumen
O significado do processo das mudanças institucionais ocorridas após o término do regime militar tem provocado inúmeras reflexões acerca da cidadania na sociedade brasileira. Diferentemente de períodos históricos anteriores, nessa conjuntura o poder judiciário passou a ser visto como de fundamental importância para a efetivação de alguns direitos à medida que as normas jurídicas têm um sentido promocional prospectivo. A partir dessas considerações, encaminhamos uma reflexão sobre o desafio do Estado brasileiro de recompor as forças e agentes de controle social (polícia e justiça) para atuar dentro dos padrões da legalidade. Para tanto, estabelecemos um diálogo com o texto de Gizlene Neder e Gisálio Cerqueira Filho no tocante à cultura jurídico-penal no Brasil, principalmente no que diz respeito aos postulados que envolvem a questão da penitência/punição e da absolvição/perdão para a vivência dos direitos no país. Abstract. The process involving institutional changes after the end of the military regime in Brazil triggered various reflections on the role of citizenship within society. Unlike in former periods, the judicial authorities started to be perceived as fundamentally important for the concretization of rights due to the fact that prospective promotional meanings are inherent to juridical norms. The current analysis deals with the challenge that the Brazilian State has had in reorganizing social control agents (the police and judiciary) to act within legality. A dialogue is thus initiated with a text by Gizlene Neder and Gisálio Cerqueira Filho on the juridical and penal culture in Brazil.
