LEIS, EDUCAÇÃO E SOCIEDADE: O BEM COMUM NA ALTA IDADE MÉDIA
Resumo
Neste artigo pretendemos analisar a estreita relação existente entre a elaboração de leis e a construção de uma sociedade voltada para o bem comum. Para analisarmos essa relação, reportamo-nos ao período histórico da Alta Idade Média. Procuramos mostrar que a identidade de uma sociedade também se constitui quando as leis são elaboradas, respeitadas e seguidas com eqüidade. Desse modo, por meio da História, podemos verificar de que maneira os indivíduos constroem suas relações de poder, governo e leis, elaborando seus laços sociais e suas características individuais e sociais. Em última instância, a História, ao nos permitir conhecernos a nós mesmos, possibilita que criemos o que acreditamos serem os interesses comuns, as leis gerais e o governo para o bem comum. O contrário, ou seja, o desconhecimento de nossas leis, de nossas identidades, implica tanto no desconhecimento das condições que criam o bem comum como, necessariamente, em sua destruição. É exatamente esse caminho que procuraremos apontar ao analisarmos alguns costumes e leis da Alta Idade Média. Abstract. The relationship between the elaboration of laws and the construction of a society inclined towards the common good is analyzed. The analysis of such relationship urges a reference to the High Middle Ages. In fact, a society’s identity is also constituted when the laws are elaborated, respected and obeyed. The way individuals construct their relationships of power, government, and laws may be verified through the study of History while they elaborate their social ties and their individual and social characteristics. When History makes human beings know themselves, a possibility for the establishment of common interests, the general laws and the government for the common good ensues. On the other hand, ignorance of laws and identities implies in the ignorance of conditions that create the common good and, necessarily, its destruction. This is exactly the way indicated when habits and laws of the High Middle Ages are investigated.Downloads
