What does the data say? A factual analysis of the (in) efficiency of brazilian judicial power
Abstract
This research aims to investigate the level of efficiency in the use of public resources by the Brazilian judicial agencies, identifying potential causes that explain the verified levels of efficiency. Usually pointed out by the media as the most expensive, slow and inefficient justice in the world, the Brazilian Judiciary has been suffering from such attacks, which even causes some discredit with part of the population. Thus, investigating the levels of (in) efficiency of the Brazilian Judicial organs can contribute to the realization of a diagnosis that serves as a first mechanism aiming at making changes that increase their efficiency and improve their image in front of society. Employing a quantitative approach through Data Envelopment Analysis (DEA) to detect efficiency levels, and a regression model with panel data to analyze the relationship between a vector of variables and the reported efficiency levels by the DEA, the research includes a sample composed of Brazilian State and Labor Judicial organs, from 2009 to 2018. As main findings, the analysis shows that the efficiency levels of the analyzed organs are relatively homogeneous, and that the verified differences are not so disparate. Still, it was verified that the personnel expenses, the level of recurability of decisions and the number of civil servants per magistrate contributes to the increase of inefficiency, while investments in IT resources contribute to improve the efficiency of the organs analyzed. The findings may contribute to public managers making the necessary changes to increase the efficiency of the agencies with the worst levels of efficiency detected.
