THE IDENTIFICATION OF THE GENETIC PROFILE OF THE DEFENDANT IN A MANDATORY FORM

Abstract

The purpose of this article is to demonstrate that the mandatory harvesting of the genetic profile of the
person convicted of intentional crimes, committed with serious violence against a person or Hedionados, does not
harm the fundamental rights of the accused, such as the principle of nemo tenetur se detegere. This new instrument
will be analyzed for constitutionality by the Supreme Court, after the general repercussion reached on the subject.
The applied methodology consists of a bibliographic review of books, articles, periodicals and interviews about
the theme. It is emphasized that this new form of criminal identification will guarantee the accused the principles
of innocence, intimacy and dignity of the human person.
