INFLUENCE OF THE MEDIA IN CRIMINAL PROCESS: NULLITIES AND UNLAWFULNESS

Abstract

This article explores the media's way of acting and its influence on criminal proceedings. Through a
theoretical-methodological perspective of the qualitative interpretative type, through a hypothetical-deductive method,
it aims to outline how the media power acts to make its discourse convincing and establish a consensus, called public
opinion as an alternative to reality. The difficulties encountered in the construction of the criminal sentence are dealt
with, the origin of the "star" judge and the disclosure of classified evidence by the media and its uselessness in the
judicial scope are outlined. It concludes by the difficulty in recognizing the social utility of spectacular media.
