CONSIDERAÇÕES SOBRE POSSÃVEIS RELAÇÕES ENTRE A VIOLÊNCIA SEXUAL INTRAFAMILIAR E OS DIREITOS DA PERSONALIDADE

Abstract: Violence is one of the social issues that concern society the most and is viewed as a public health matter worldwide. When it comes to the family scope, it is observed that the intrafamilial sexual violence is currently gaining prominence, mainly due to the domination power that the abuser has over the victims. It is important to stress that the offender disguises himself as someone related to the child, be it via the nuclear family or the extended one. It is necessary to conceptualize what are the personality rights, and consequentiallly, how they are are affected when the minor is sexually assaulted by their realtives. Through bibliographic research concearning this issue, the possible correlations and consequences between the intrafamilial sexual violence and personality rigths were analyzed, with the legal guidance from the federal constitution that tend to this matter, the current laws and in the brazilian child and adolescent statue (ECA).
