Abstract

This study aims to debate about the legitimacy of the instruments used by Public Universities to carry
out policies for the inclusion of the Afro-descendant population. To this end, the bibliographic and jurisprudential
research method will be used, addressing the issues of self-declaration in the face of the Brazilian legal system and
the “conflict” of its legitimacy. Along this path, considering that Universities still reflect Brazilian social
inequality, it is necessary to argue about the legitimacy of self-declaration as a criterion for effecting ethnic-racial
affirmative actions for access to higher education. For this, the deductive method was used.
