LAW AND LITERATURE IN HANNAH ARENDT AND “THE READER”

Abstract

With the emergence of a critical thinking in
Law, there is an opening to other areas of knowledge, like
Literature. Based on this, the proposition, in this article, is to
analyze the possibilities brought by the jusliterary relation,
considering that Literature has the potentiality of developing a
critical thinking and an awareness in jurists. Therefore, it is
based in the thinking of Brazilian researches André Karam
Trindade e Lênio Streck, and in the relation between the literary
work “The Reader”, of Bernhard Schlink, and Hannah Arendt’s
legal philosophy, notably regarding the banality of evil, found,
mainly, in the book “Eichmann in Jerusalem”.
