AN ANALYSIS OF THE BRAZILIAN URBAN SOCIOSPATIAL INFORMALITY AND THE RECOGNITION OF THE RIGHT TO A SLAB BY THE CIVIL CODE

Abstract

This present article has the purpose to analyze historically the formation of Brazilian´s outskirts
around large urban centers, approaching in a summarized way its genesis and recognition as part of the
cities. Is yet to be discussed the non-existence of efficient public politics to deal with the subnormal urban
agglomeration in Brazil and the favelas structures as a suis gereris communities. In this context it will be
explained the existence of the slab right in the daily community routine way before the enactment of law
nº 13.465/2017. Also, it´s going to be discussed the constitutionalization of the civil law and the
improvement of the right to housing as a social right fundamental as well as property right and its social
function limitation. And last, but not least, it will be considered the recognition of actual situation in the
outskirts around the country through the law nº 13.465/17, that creates a new real rights, engraved on item
XIII, from the Art. 1.225. of the Civil Code and its legal consequences.
