ANALYSIS OF THE LAWS RELATING TO NON-PROFIT PRIVATE INSTITUTIONS FROM THE REPUBLICAN PERIOD UNTIL THE CONSTITUTION OF 1988
Abstract
The present study sought to analyze the Brazilian legislation in relation to non-profit private institutions. The analysis depicted in this study reflects the period related to the beginning of the Republic in Brazil until 1988. In the first moment, the purpose was to identify and characterize what has been called Third Sector. At second, the purpose was to identify within the Republican period provisions of the Constitution and ordinary and complementary laws that could characterize or fit into the adopted classification of non-profit private institutions. In order to accomplish the purposes of the study a literature review with studies conducted in the area and documental search were performed. The findings demonstrated three main factors in the Brazilian legislation regarding non-profit private institutions: a) significant increase in the number of these institution in the analyzed period; b) professionalization of these institutions and; c) transferring of the role played by the State in relation to public polices offered to attend social demands.
