AFFECTIVE ABANDONMENT IN FAVOR OF CHILDREN AND PUNITIVE DAMAGES
Abstract
This work aims to analyze the possibility of compensation for moral damages arising from affective
abandonment under the focus of "punitive damages", which is indeed a relevant topic in the legal sphere. The
concept of family went through modifications, and the law needs to accompany them; after all, it is necessary to
establish criteria that enable healthy family relationships. With the advent of the Federal Constitution of 1988, new
principles of Family Law were established, such as: human dignity and affectivity. Then, the limits of parental
responsibility will be explained, considering the possibility of indemnity for moral damages arising from emotional
abandonment on a punitive approach.
