Abstract

The legal foundations contained in Declaratory
Actions of Constitutionality n. 43 and 44, and Direct Action of
736. Mestranda em Direito pelo Programa de Pós-Graduação
em Direito da Universidade Federal de Santa Catarina
(UFSC), Florianópolis, na área de concentração Teoria e
História do Direito. Bolsista pela CAPES-Coordenação de
Aperfeiçoamento de Pessoal de Nível Superior. Membra do
grupo de pesquisa em História da Cultura Jurídica Ius
Unconstitutionality by Omission n. 26 involve the collision of
constitutional principles of equal hierarchy: the presumption of
innocence, human dignity and legality. From the analysis of
these judgments, this research aims at understanding how does
the Brazilian Federal Supreme Court make its decision in hard
cases judgments on regarding constitutionality control were
given the conflict between the principles on which underlie the
Brazilian Democratic State.
