MECHANISMS FOR THE PREVENTION OF THE PRACTICE OF BIDDING CRIMES

Abstract

Notoriously, fraud in bidding procedures are frequent phenomena in the Public Administration of
Brazil, through which large sums of public resources are subtracted in order to meet interests not consistent with
public commitment. Under this perspective, this work will have the scope of evidencing mechanisms that can
avoid the practices of crimes described in Law nº 8.666/1993, as well as in Bill nº 4.253/2020, which intends to
revoke the current Law nº 8.666/1993, and bring important changes in the criminal field. For this, the hypotheticaldeductive
method was adopted, based on the bibliographic analysis on the theme. In the end, the conclusion was
reached of the need to implement mechanisms that can effectively curb criminal practice within the scope of public
administration.
