Work Performed in Confined Spaces in the Light of Personality Rights

Abstract

This study presents an analysis of work carried out in confined environments in the light of personality rights, in order to explore its implications. The general objective of this article is to investigate how working conditions in confined spaces, as defined by Regulatory Standard No. 33 (NR-33), affect workers’ personality rights. The specific objectives include: examining working conditions in such environments; assessing the effects of these conditions on workers’ physical, psychological, and social integrity; identifying the main violations of personality rights arising from these conditions; and, finally, suggesting measures that may be adopted to ensure the safety and well-being of workers subjected to this type of environment. The methodology adopts a qualitative approach to data collection and analysis, using the hypothetical-deductive method of investigation. In conclusion, this study provides a foundation for future research and seeks to encourage academics and legal professionals to engage in discussion on the protection of workers in confined environments. By highlighting issues of dignity and fundamental rights, the research underscores the promotion of safety and respect for the individuality of these professionals.

Holds a qualification as an Occupational Safety Technician from Colégio Estadual Mal Rondon – Elementary, Secondary and Vocational Education. Works as an attorney, with an interest in various areas of Law, especially committed to an ethical, critical practice oriented toward social justice.
