Abstract

RESUMO: Discute-se largamente no Brasil a necessidade de existência deformas alternativas para a resolução de conflitos, sempre no intuito de apaziguaros ânimos dasociedade, detomar mais célere a entrega da prestação jurisdicional, de desafogar o Poder Judiciário e de promover amplo acesso à Justiça. Nesse sentido, pode- se observar a existência de meios de heterocomposiçãoou de autocomposição onde a arbitragem, a mediação e a conciliação despontam como instrumentos hodiernos direcionados à ampliação do acesso à Justiça, cumprindo ressaltar que tais modelos poderão ter sua aplicação ampliada para os conflitos ambientais, que se constituem no núcleo do presente estudo.
