POLUIÇÃO HÍDRICA: ASPECTOS FUNDAMENTAIS DA TUTELA JURÍDICO PENAL NO BRASIL
Abstract
Apoluiçãohídrica constitui um dos mais graves problemas de degradação ambiental da atualidade. A inescusável importância da água para aexistência humana evidencia que ohomem deve sevaler de todos os instrumentos hábeis atutelar esse recurso natural esgotável, mas demasiadamente aviltado nos dias atuais. A intervenção do Direito Penal na proteção dos recursos hídricos contra apoluição é legítima e estritamente necessária. Todavia, no sistema jurídico-penal brasileiro, odelito depoluição hídrica é abarcadopelo art. 54da Lei n. 9.605/ 1988,que, por seutratamentoexcessivamente genérico, contrário ao primado dalegalidade, sobretudo em sua vertente da determinação,
traz a lume questionamentos acerca de sua constitucionalidade eefetividade.
