Abstract

O texto que se segue objetiva demonstrar que o Estado Democrático de Direito não pode se consubstanciar quando as leis são aplicadas de forma intermitente e, consequentemente, devem ser criados e aplicados mecanismos que possam mitigar essa grave falha que permeia o campo jurídico-político no âmbito do direito punitivo, dando-se ênfase, neste mister, ao desenvolvimento teórico do princípio da culpabilidade compartilhada.
