Abstract

O autor indaga em sua exposição se o Direito Penal garantista de um Estado de Direito foi perdido ou abandonado e se, nos dias de hoje, pode ser substituído por um Direito Penal menos garantista ou até sem garantias, como o programa do Direito Penal do Inimigo sugere.
