structural negligence and the legal void in ‘longe do ninho’
Abstract
This review analyzes the work Longe do Ninho (2024), by Daniela Arbex, from a legal-critical perspective, examining the implications of civil, criminal, and administrative liability arising from the fire that occurred at Flamengo Football Club’s Training Center in 2019. The objective is to demonstrate how the journalistic narrative functions as probative material capable of evidencing structural negligence and the assumption of risk. The methodology is based on cross-referencing the facts narrated in the book with legal doctrines, such as the Principle of Human Dignity and the Economic Theory of Law. The study concludes that the book denounces not only a foreseen tragedy, but also the failure of state oversight mechanisms and the inadequacy of the Brazilian justice system in pedagogically sanctioning large corporations, resulting in a “second death” of the victims through impunity and institutional silencing.
