Abstract

This article aims, from historical elements and fundamentals of free speech and personality rights, to
study the current phenomenon that happens in the virtual world through virtual networks regarding the immense
dissemination of false news, which, of course, it is an abuse of the right to free speech. There is the Fake News
Bill that contributes to the fixation of some contours that aim to curb this dissemination of disinformation. Thus,
it will be analyzed whether the opposition between possible contours to freedom of expression and/or protection
of the population is censorship or protection.
