Ementa da Redação: O advogado que orienta testemunhas a falsearem a verdade é co-autor do crime de falso testemunho, pois sem a orientação do causídico, as testemunhas não iriam mentir em juízo; desse modo, não há que se falar em falta de justa causa para instauração da ação penal.
Ementa do voto vencido, pela Redação: O advogado que sugere à testemunha favorecer seu cliente não pratica o crime de falso testemunho ou falsa perícia, visto a atipicidade da conduta.
