ALIMENTOS CONTAMINADOS POR AGROTÓXICOS E SEU TRATAMENTO JURÍDICO-PENAL

Abstract

A saúde pública foi expressamente reconhecida como direito fundamental no texto magno. Igualmente são fundamentais os meios para a saúde, dentre os quais se destacam os alimentos. Em face de sua importância, olegislador criminalizou comportamentos lesivos ou perigosos à saúde pública e, em particular, as chamadas fraudes alimentares. Contudo, importa verificar se a contaminação de alimentos por agrotóxicos pode ser considerada uma das modalidades de fraude alimentar e, nesse caso, em qual dos tipos de injusto enquadra-se a conduta do agente que promoveu referida contaminação.
