Abstract

The article analyzes the protection of people with disabilities from a historical, social, and legal perspective. It highlights that, over time, disability has been treated as a factor of exclusion, especially after industrialization, which reinforced standards of normality and increased inequalities. However, this exclusion stems more from social barriers than from individual limitations. At the international level, the study addresses the Convention on the Rights of Persons with Disabilities and the Marrakesh Treaty, which, in a complementary way, promote inclusion and access to information, consolidating the transition to a human rights-based model. The text also emphasizes the shift from the medical model to the social model of disability, in which exclusion results from barriers imposed by society. In this context, biopsychosocial disabling—especially in the digital environment—and ableism are highlighted as forms of structural discrimination. It concludes that inclusion requires the removal of barriers and the effective enforcement of fundamental rights, constituting a legal and social duty grounded in human dignity.
