Abstract

Driven by the advent of technology and the
development of the internet, the sharing economy has emerged and
developed quickly, but is currently the subject of controversy in the
Brazilian legal system, as it presents legal-regulatory challenges in
civil, real estate and competitive law, and directly impact service
sector. Thus, the present paper seeks to offer elements for a critical
reflection on the sharing economy, proposing a regulatory model
based on Responsive Theory that satisfies the public interest and
guarantee constitutional principles.
