Abstract

This study aims to make a critical analysis of legislation regulating the inclusion of disabled students in higher education in Brazil and Portugal. Based on a documentary study, conducted between September and November 2015, the legal standards in recent decades have been analyzed. The results point out different stages of construction of the inclusion policy in the researched countries. It is emphasized that there is a significant variety of norms in the Brazilian context to ensure that these students have equal opportunities, and a scarcity of regulations in Portugal. The legislation has been referred to as an important factor for the development of inclusive education; however it is noteworthy that the existence of legislation does not necessarily imply it is actually complied. Besides legislation, removing barriers for the full participation and learning of disabled students involves awareness, investment in resources, public policy makers and managers’ scientific knowledge to ensure a quality education throughout life for all people.

Francisco Ricardo Lins Vieira de Melo, Universidade Federal do Rio Grande do Norte

Graduação em Fisioterapia pela Universidade Federal da Paraíba (1993), mestrado (2002) e doutorado (2006) em Educação pela Universidade Federal do Rio Grande do Norte/UFRN. Atualmente é professor Associado do Departamento de Fisioterapia e do Programa de Pós-graduação em Educação da referida instituição. Trabalhos desenvolvidos na area de inclusão social e educacional da pessoa com deficiencia, com investigações particularmente no acesso e permanencia de estudantes com necessidades educacionais especiais no ensino superior.

Maria Helena Martins, Universidade do Algarve

Licenciatura em Psicologia Educacional, Instituto de Psicologia Aplicada de Lisboa (1991); Mestrado em Educação Especial ? Universidade Técnica de Lisboa - Faculdade de Motricidade Humana (1996); Doutoramento em Psicologia da Educação ? Universidade do Algarve (2006).

Atualmente: Professora Auxiliar na Universidade do Algarve, Faculdade de Ciências Humanas e Sociais. Foi desde 2009 a 2014 Diretora da Licenciatura de Psicologia e Subdiretora da Faculdade de Ciências Humanas e Sociais da Universidade do Algarve de 2012 a 2013. Desde 2013 atua como coordenadora do Gabinete de Apoio ao Estudante com Necessidades Educativas Especiais - GAENEE da UAlg.
